Valley Metro which provides bus service for the Phoenix metro area got sucked into buying new computerized fare boxes for all their buses. The computers cost a little over $10,000 and they don’t work very well. Often they take your money and don’t give you a pass back. They are computerized thieves!

On Wednesday October 1, 2008 the first two buses I rode on I rode for free because the computerized fare boxes were broken.

The third bus I got on the computer was actually working and I paid for an all day bus pass. An all day bus pass is good for just that ALL DAY, or till the buses stop running.

Prior to today I had only encountered one mentally ill bus driver. Valley Metro has a policy of not allowing you to take soft drinks or coffee on the buses in flimsy containers. A hard container is OK. I suspect this policy is to prevent people from spilling drinks on each other.

Well I got on a bus with an EMPTY 44 ounce Circle K soda cup, which I had stuffed a burrito into and the moron driver ordered me to throw the cup away.

I told him the policy only applied to cups with liquids in them and this cup was EMPTY. The mentally ill *sshole driver ordered me to throw the cup away or get off the bus.

I wanted to bitch but because I had stuff to do I thru the cup away in the trash can at the front of the bus. And when I got off the bus I reclaimed my cup.

I asked a number of other drivers what a person should do when they encounter a mentally ill bus driver who orders you to do irrational things. They all pretty much told me to order the driver to call his dispatcher and force the dispatcher to make the decision.

Since then I had not encountered another mentally ill bus driver, or perhaps this driver isn’t mentally ill, maybe he is a racist *sshole. I don’t know.

Any how today Wednesday October 1, 2008, shortly before 5:40 p.m. I hopped on the 92 bus which was bus number 4103 at Priest and Broadway wanting to got to downtown Tempe and scanned my valid bus pass thru the computerized fare box and got on.

The driver who is a Black guy was wearing a badge that identified him as Ty and said he was driver number 5420. The driver then told me I could not ride on his bus unless I threw away my walking stick. At this point I thought the driver was the second mentally ill Valley Metro bus driver I had met. On a second thought maybe he is not mentally ill. Maybe he is a racist *sshole and treating me this way because I am White.

I explained to driver #5420 with the name of Ty that this was my walking stick and I take it with me on all the other buses and none of the other drivers complained about it.

Ty or driver number 5420 started to look like a real ahole! He told me to throw the stick away or get off his bus and take the next bus.

At this point in time I figured it was time to pass on the problem to his dispatcher and get the dispatcher to solve the problem. I know its legal to carry my walking stick on the bus and the driver is either mentally ill or and ahole. So I asked driver number 5420 or Ty to call his dispatcher.

Ty or driver number 5420 became angry and said he wasn’t going to call his dispatcher and ordered me off of the bus and to take the next bus.

I did make one more concession to Ty or driver 5420 and I told him if it would make him happy I would leave the walking stick at the front of the bus so he could watch it. Ty is a very angry no compress man and order me off the bus and tells me to take the next bus. No I couldn’t leave the stick at the front of the bus. No he would not call his dispatcher, and I had to get off his bus and take the next bus.

Ty or driver #5420 even had the gall of telling me that I was making his passengers late! The jerk is ordering me off the bus for a ride that I have paid for and when I refuse he is saying I am making his passengers late! If the ahole would shut up and let me on the bus his passengers would be on time.

Last but not least another Black guy who also appears to be a racist comes into the scene. A black guy was sitting at the front of the bus and he gets out of his seat and assaults me and orders me off the bus. He yells at me and says I am making him late. This guy was wearing a badge that says he is Clifford Wilbert and that he works for CISCO. The bus driver Ty or #5420 should have yelled at Clifford Wilbert and told him to stop assaulting his passenger (which was me), but he didn’t, Ty the bus driver condones this assault by a passenger on me.

At that point in time I get off the bus because I figure Clifford Wilbert is going to physically harm me.

One thing that confuses me about bus driver Ty or driver number #5420 as Valley Metro calls him. Why did he keep telling me to take the NEXT bus? I suspect because he knows there is no rule that says I can’t take a walking stick onto the bus and that the next bus, if its not driven by a racist mentally ill person will let me on with out any problems and take me to downtown Tempe.

OK, I am off the bus and I take a bus book and scribble down a few notes. You can see the notes because I have scanned them and attached them to this web page. You can also see my bus pass. I scanned it too and it is an all day bus pass valid for Oct 1, 2008. I wrote bus driver Ty’s name and number on the bus pass. I also wrote the name of Clifford Wilbert the employee of CISCO who assaulted me on the bus and forced me off of the bus.

Now at this point neither bus driver Ty or Clifford Wilbert know that even if I am a homeless person I do know how to file lawsuits against cops in the Federal Court system and that I will be filing a lawsuit against Ty, Clifford Wilber, the City of Tempe, Valley Metro and of course Veiloa the company that operates the Tempe buses in Federal Court for civil rights violations and false arrest.

But back to the next bus. Will that driver let me on the bus as they have always done or will he order me off the bus because I look like a terrorist with a walking stick.

The next bus comes along. It is also a 92 bus. It is bus number 4122. I get on the bus at about 5:53 p.m. The boarding is uneventful. The driver says nothing about my walking stick. In fact the driver says nothing at ALL.

While I am on the bus I start writing down things on my notes which I will need for my lawsuit. I wrote down the bus number, which I just said was 4122. I also write down the time, which was about 5:53 p.m. Oct 1, 2008. I take the bus to downtown Tempe and get off the bus at about 6:02 p.m.

I say nothing to the driver of this bus until we were about three fourths of the way to downtown Tempe and then I tell them what happened with the last bus driver. Like me he seems to think the bus driver Ty is mentally ill or a crackpot weirdo.

When I got off this bus I saw the last 92 bus there parked. The racist driver Ty who kicked me off was outside the bus taking to Clifford Wilbert the guy who assaulted me and threw me off the bus. I wonder does Clifford Wilbert work for CISCO or Valley Metro? He has a CISCO badge buy he is talking to the racist driver Ty like they are good buddies.

I saw the bus driver who has a large cache of arms in his home. He is driving on of those shuttle buses. You know Earth, Mars, Venus or one of them named after the planets. I tell him about my experience and he at first thinks I am making it up, then he also says the driver Ty must be a wacko.

Weapons on buses?

Are weapons allowed on buses, assuming the driver says my walking stick was a deadly weapon?

Well according to the ARS 13-3102.01 (posted at Tempe Library) if they ban weapons in a building or vehicle they have to allow you to check the weapon.

In this case I offered to check my weapon or give my stick to the driver and he refused.

For that matter it appears that his law is the reason Valley Metro stopped banning weapons on their buses.

Maybe about four years ago Valley Metro policy was that no weapons were allowed on buses.

I suspect that somebody threatened them with a lawsuit saying if Valley Metro was going to ban weapons they had to allow them to be checked. And since buses do not have the space, boxes nor does the driver have the time or the means to check weapons Valley Metro reluctantly gave up on its police state policy of banning guns on buses.

10. Unless specifically authorized by law, entering any public establishment or attending any public event and carrying a deadly weapon on his person after a reasonable request by the operator of the establishment or the sponsor of the event or the sponsor's agent to remove his weapon and place it in the custody of the operator of the establishment or the sponsor of the event for temporary and secure storage of the weapon pursuant to section 13-3102.01;
